These Terms and Conditions govern your use of the services provided by Diesel and Dust Towing and Auto Ltd . By requesting our towing, roadside assistance, or any other service, you agree to be bound by these Terms.

1. Services Provided

We provide 24/7 towing, vehicle recovery, and roadside assistance services, including but not limited to towing, boosting, winching, lockout service, fuel delivery, and tire changes.

2. Service Requests and Fees

Quotes: All initial quotes are estimates. The final fee may vary based on the specific circumstances encountered at the service location, including time, distance, complexity, and required equipment. Payment: Payment is due upon completion of service unless prior arrangements have been made. We accept cash, major credit/debit cards, and approved direct billing. A service call fee may apply regardless of whether service is rendered if the driver is dispatched. Additional Charges: Additional fees may apply for services required beyond the initial request, waiting time, winching, after hours service, or recovery from private property without proper access.

3. Customer Responsibilities

You must provide accurate information about your location, vehicle, and problem. You warrant that you are the legal owner or authorized agent of the vehicle requiring service. You are responsible for removing all personal belongings from your vehicle before towing. We are not liable for any items left in the vehicle.

4. Limitation of Liability

Our services are provided "as is." While we exercise due care, we are not liable for any pre existing, concealed, or latent damage to your vehicle or property. We shall not be liable for any indirect, incidental, or consequential damages arising from our service, including loss of use, income, or data. Our total liability for any claim related to our services shall not exceed the total amount you paid for the specific service in question.

5. Indemnification

You agree to indemnify and hold harmless Diesel and Dust Towing and Auto Ltd, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms, your negligence, or your misrepresentation.

6. Right to Refuse Service

We reserve the right to refuse service to anyone at our discretion, including in situations we deem unsafe, illegal, or where the customer is belligerent or non cooperative.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts in Regina, Saskatchewan.

8. Changes to Terms

We may revise these Terms at any time. The most current version will be posted on our website. Continued use of our services after changes constitute acceptance of the new Terms.
